F3 Sports is a d/b/a of 4Rabbis, LLC, a New Jersey limited liability company (“F3 Sports”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, www.funfanfacts.com (the “Site”), and any related content, features, and communications (collectively, our “Services”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Notice, which is incorporated into these Terms by reference, and if you do not agree to these Terms, please do not access or use the Site. We may update these Terms periodically, and any changes will be posted on the Site and take effect immediately upon posting, so we encourage you to review these Terms from time to time.

Acceptance of These Terms

These Terms form a binding agreement between you and F3 Sports. By accessing or using the Site, you represent that you are at least 13 years of age, or that you are a parent or guardian accessing the Site on behalf of a minor, and that you have the legal capacity to enter into these Terms.

The Site Is Informational

The Site is an informational and promotional resource for our publications and related projects. The Site is not a store. We do not sell products or process payments through the Site.

Purchases Through Third Parties

Our books and other products are sold through third-party retailers, marketplaces, and distributors, including Amazon and Ingram Spark. When you click an outbound link on our Site to purchase a book, you leave the Site, and any purchase you make is a transaction between you and that third party, governed solely by that third party’s terms of sale, privacy policy, and return and refund policies. We are not a party to those transactions and are not responsible for them. References on the Site to products available through third parties are provided for convenience and do not constitute an offer to sell by us.

Intellectual Property

All content on the Site, and all of our brand and creative assets wherever they appear, are owned by F3 Sports or its licensors and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws. This includes, without limitation, all:

  • text, copy, and editorial content;
  • images, photographs, illustrations, artwork, and graphics;
  • characters and mascots, including all related designs, names, and depictions;
  • logos, wordmarks, and trade dress;
  • book covers, page designs, layouts, and the overall look and feel of the Site and our publications; and
  • the selection, arrangement, and compilation of any of the foregoing

(collectively, the “Materials”).

Reservation of rights; no license. All rights in the Materials are reserved. Nothing on the Site grants you, by implication, estoppel, or otherwise, any license or right to use any of the Materials. No use, reproduction, distribution, public display, public performance, transmission, modification, adaptation, or creation of derivative works of the Materials is permitted without our prior express written permission. You may not download, scrape, copy, harvest, or extract images or other Materials from the Site, except for the routine technical caching your browser performs to display a page. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notice, or any embedded rights-management metadata, contained in or attached to the Materials.

Trademarks

F3 Sports | Fun Fan Facts is our trademark (U.S. Trademark Application Serial No. 99693263, pending). Our other names, logos, and mascots are also protected as trademarks and trade dress. All other names, marks, and logos appearing on the Site are the property of their respective owners, and their appearance on the Site does not imply any affiliation with or endorsement by us. You may not use any of our trademarks without our prior written permission.

Acceptable Use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • access the Site through automated means (bots, scrapers, or crawlers), except for well-behaved search engine indexing;
  • attempt to gain unauthorized access to the Site, its servers, or any related systems;
  • interfere with or disrupt the operation, security, or integrity of the Site; or
  • use the Materials in any way that infringes our intellectual property rights or those of any third party.

Email and Communications

If you provide your email address through the Site, you consent to our use of it as described in our Privacy Notice, including to send you the communications you have requested and information about our products. You may opt out of marketing emails at any time using the unsubscribe link in any such email, or by contacting us at hello@funfanfacts.com.

The Site may contain links to third-party websites and services, including retailer and marketplace pages. We provide these links for convenience only. We do not control, and are not responsible for, the content, products, policies, or practices of any third-party site. Your use of any third-party site is at your own risk and subject to that site’s terms.

Children

The Site is intended for a general audience and is not directed to children. While many of our products are created for children, the Site is directed to parents, guardians, educators, retailers, and other adults. We do not knowingly collect personal information from children under 13 through the Site. By using the Site, you represent that you are at least 13 years of age, or that you are a parent or guardian acting on behalf of a minor. If you believe a child under 13 has provided us personal information through the Site, please contact us at hello@funfanfacts.com, and we will take reasonable measures to delete it. Disclaimer of Warranties

The Site and all Materials are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on the Site is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, F3 Sports and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to use) the Site, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless F3 Sports and its members, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.

Changes to the Site and These Terms

We may modify, suspend, or discontinue the Site, or any part of it, at any time without notice. We may also revise these Terms from time to time, and any revised Terms will be posted on the Site and take effect immediately upon posting. Your continued use of the Site after we post changes constitutes your acceptance of the revised Terms.

Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Essex County, New Jersey, and you consent to the personal jurisdiction of those courts.

Miscellaneous

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Notice, are the entire agreement between you and us regarding the Site.
